The Court of Arbitration for Sport (CAS), also known by its French acronym TAS, is the primary forum for resolving disputes in international sport. For athletes, clubs, agents and federations, understanding how it works — and how it differs from ordinary courts — matters well before a dispute actually arises.
What Is the Court of Arbitration for Sport?
CAS is an independent arbitration institution, based in Lausanne, Switzerland, that resolves disputes related to sport through arbitration rather than through national court systems. Most major international federations and many national federations have adopted CAS jurisdiction in their statutes or in athlete and club contracts.
Who Can Bring a Case to CAS
Access to CAS generally requires either an arbitration clause in a relevant contract (an employment contract, transfer agreement, or federation regulations) or a specific agreement between the parties to arbitrate before CAS. Athletes, clubs, agents, federations and sponsors can all be parties, depending on the nature of the dispute.
The Ordinary and Appeals Divisions
CAS operates through an Ordinary Arbitration Division, which hears disputes submitted directly to CAS (commercial and contractual disputes, for example), and an Appeals Arbitration Division, which reviews decisions already made by federations or other sports bodies — most commonly disciplinary and doping-related decisions.
How a CAS Proceeding Unfolds
A case begins with a statement of claim or appeal, followed by a response, appointment of one or three arbitrators from CAS's specialized list, an exchange of evidence, and typically a hearing. Proceedings are generally faster than ordinary litigation, and awards are binding on the parties.
Challenging a CAS Award
CAS awards are not subject to a full appeal on the merits. They can be challenged before the Swiss Federal Tribunal, but only on narrow procedural grounds — such as a fundamental violation of due process — not because a party disagrees with the outcome. This makes preparation and representation at the CAS stage itself especially important.
